What Is Sexual Abuse in a Nursing Home?

Sexual abuse occurs when a resident is subjected to non-consensual sexual contact, behavior, or exposure by a caregiver, staff member, visitor, or another resident. Because many victims have dementia or other cognitive impairment, they may be unable to consent, or to later explain what happened to them.

Sexual abuse may involve:

  • Unwanted touching or fondling
  • Forced nudity or exposure
  • Sexual assault
  • Inappropriate photography or recording
  • Sexual harassment or coercive behavior
  • Exploitation of a resident unable to consent

Because many victims cannot describe what happened to them, sexual abuse often goes undetected far longer than other forms of mistreatment — sometimes discovered only through a sudden behavioral change, an injury, or a medical finding during an unrelated exam.

Why Sexual Abuse Happens in Care Facilities

There is never an excuse for sexual abuse. But certain facility conditions make it more likely to occur and less likely to be caught. Common contributing factors include:

Inadequate Background Screening

Some facilities fail to properly vet employees or contractors, including checking for prior allegations or convictions.

Lack of Supervision

Residents are often left alone with a single caregiver for extended periods, with no camera coverage or check-in protocol.

Failure to Investigate Complaints

When staff or other residents report concerning behavior, facilities sometimes dismiss or bury those reports instead of investigating them.

Targeting of Cognitively Impaired Residents

Residents with dementia or communication difficulties are disproportionately targeted because they are less likely to be believed or able to report what happened.

Culture of Silence

Facilities focused on protecting their reputation over their residents may discourage staff from reporting suspected abuse.

Research reviewed in peer-reviewed literature on nursing home sexual abuse has found that residents with dementia or other cognitive impairment may account for as much as 60% of victims, and that sexual abuse remains the least reported form of elder mistreatment in survey data.
