Case Study: 1,437 Rights Violations and a Preventable Death in a California Nursing Home

A military veteran in his 70s spent the final 13 months of his life in a Northern California nursing facility. During that stay, the facility cycled through multiple directors of nursing — and, for stretches of time, had no director of nursing at all.

Staff failed to transport him to scheduled chemotherapy appointments on at least seven occasions, causing him to miss treatment for his cancer. He also developed a large, untreated pressure sore. He died following its progression.

His family brought a claim under California's Residents' Bill of Rights. An Alameda County jury found 1,437 separate violations — reported to be the largest number of Bill of Rights violations a California jury has ever found in a single case — and awarded the family $7.6 million.

What makes this case instructive isn't just the size of the verdict. It's the structural failure underneath it: a facility that operated for extended periods without the supervisory role responsible for clinical oversight, leaving line staff without the training or accountability that role is meant to provide. When that infrastructure is missing, harm isn't an accident — it's a predictable outcome of how the facility chose to operate.

A Promise the Facility Didn't Keep

Transportation to his ongoing cancer treatment was reportedly one of the main reasons the family chose this facility in the first place. The facility failed to provide it at least seven times, disrupting his treatment during a period when he was medically fragile but still responding to care.

Records That Didn't Match Reality

Perhaps the most damning detail to emerge at trial: certified nursing assistants had documented turning and repositioning him on the care chart — at times when he was not even in the facility to be repositioned. Records later showed more than 500 missed turning and repositioning entries overall. The pressure sore that resulted from that lack of care became severe enough to tunnel down to the bone before it was meaningfully addressed.

A Year Without Consistent Oversight

Over his 13 months at the facility, the position responsible for clinical oversight of nursing care turned over repeatedly, and for stretches of time went unfilled entirely. Line staff were left without the training, supervision, and accountability that role exists to provide — which is consistent with both the falsified records and the missed care that the jury ultimately found.

What the Verdict Was Built From

After a six-week trial, the jury didn't return a single lump-sum number — it built the verdict from its findings: $718,500 in statutory damages for the 1,437 Bill of Rights violations (at $500 each), $918,500 for his pain and suffering under a negligence and elder neglect theory, and punitive damages of $2 million against the facility operator and $4 million against a separate management company found to share responsibility for how the facility was run — a total of $7,637,000. Separating the award that way let the jury hold each layer of the operation, not just the building where he lived, accountable for its share of what happened.
